BOEMRE – commercial lease for Cape Wind Energy Project
The Bureau of Ocean Energy Management, Regulation, and Enforcement (BOEMRE) issued a notice stating that it has issued a Commercial Lease of approximately 46 square miles of submerged lands in Nantucket Sound to the Cape Wind Energy Project for construction and operation of an offshore wind farm. The 33-year lease provides for payment of $88,278 in annual rent prior to production and a two to seven percent operating fee rate following start of production. 75 Fed. Reg. 81637 (December 28, 2010).
Seattle – safety zone for potential unexploded ordinance
The US Coast Guard established a temporary safety zone on certain waters of Elliott Bay in Seattle to ensure safety of persons and property due to the presence of discarded military munitions in close proximity to Pier 91. The safety zone will be in effect through April 15, 2011. 75 Fed. Reg. 81467 (December 28, 2010).

The US Coast Guard has established a temporary safety zone at The Dalles Lock and Dam on the Columbia River to ensure safety of persons and property while the US Army Corps of Engineers completes repairs to the lock. The safety zone will be in effect through April 1, 2011. 75 Fed. Reg. 81464 (December 28, 2010).
OFAC – economic sanctions against Iran
The US Office of Foreign Assets Control (OFAC) promulgated its official notice of new economic sanctions against Iran. Included on the list are affiliates of the Islamic Republic of Iran Shipping Lines (IRISL). The sanctions came into effect on November 30. 75 Fed. Reg. 81715 (December 28, 2010).
NOAA – Sperm whale recovery plan
The National Oceanic and Atmospheric Administration (NOAA) issued a notice stating that it has adopted a Recovery Plan for the sperm whale, an endangered species. 75 Fed. Reg. 81584 (December 28, 2010).
California – marine invasive species report
The California State Lands Commission (SLC) posted its 2011 Biennial Report on the California Marine Invasive Species Program. The report states that compliance with ballast water management reporting requirements is quite high. SLC has recently begun requiring reports on hull husbandry. It continues to review availability of ballast water treatment technology. Questions have been raised about whether the technology can meet California standards and whether system performance at that level can be verified. (12/23/10).
India – Minister calls for three-fold increase in port capacity
The Indian Ministry of Shipping issued a press release stating that Shipping Minister proposes that the capacity of Indian ports be increased by 11.32% annually through 2020 so that it can sustain the growth rate of the nation’s economy. (12/22/10).

Interesting Senator Boxer of California kills ballast water legislation passed in the house 395-7, back in 2008 that would have protected the whole country equally over her wish for California to be able to enact stronger laws. Now articles are saying California is backing down on its current ballast water laws for being to strict. NY laws will be next to go, making President Obamas week military plan look attractive. Senator Boxers position in 2008 killing ballast water legislation, to allegedly preserve her states rights to stronger laws, (despite president Obama's reported rhetoric voicing support for legislation) was as the sponsor of the bill, former Rep Oberstar suggested "bullshit" and now it is being proven by California's latest action.
ReplyDeleteNow after all the wasted money this administration created leaving the states to create useless laws, the Presidents delayed Coast Guard plan will provide a weakened standard with a longer time line and President Obama and the Coast Guard will be praised for creating protection, when the reality will be, that the killing of the legislation the house voted for in 2008 and the delayed weakened plan will favor the foreign shipping industry more than the American environment and human health nor will it help create a level playing field for American manufacturing cost.
It really is not funny how our politicians waste our money to posture their political stature. Odd Paterson, governor of NY, ask by President Obama to step aside created strong ballast water laws- GONE!, Strickland strong advocate for ballast protection- GONE!, Oberstar creator of ballast legislation h.r.2830- GONE! Granholm strong advocate for national ballast water regulation mentioned for Obama positions,- GONE- PASSED OVER! Governor Schwarzenegger strong environmental advocate for ballast water, GONE!- coinciding with a newly created weakening of California's ballast water laws. Senator Boxer the killer of national ballast water laws RETAINED!, with large show of support from President Obama during elections.
